THE HON’BLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION No.35824 of 2014 Dated: 25.11.2014 Between:
M/s. VST Industries Limited Rep. by its Company Secretary & DGM-Legal Mr. Nitesh Bakshi .. Petitioner and Southern Power Distribution Company of Telangana Ltd. Rep. by its Chairman & Managing Director and others.
.. Respondents Counsel for the petitioner: Mr. Challa Gunaranjan Counsel for the respondents: Mr. O. Manohar Reddy The court made the following:
ORDER:
This writ petition is filed assailing the action of the respondents in raising a demand for Rs.43,63,940/- under the revised bills issued for the months of February, 2013 to August, 2014, towards open access final settlement account.
Respondent No.2 has addressed letter dated 11.08.2014 to the petitioner, granting 14 days’ time to pay the demanded amount, failing which it was stated that power supply will be disconnected. Even prior to the issue of this letter, the petitioner has raised objections to certain demands made by the respondents in connection with the power supply through open access. After the said letter was issued, the petitioner has sent its objections on 21.08.2014, 13.10.2014 and 11.11.2014. The grievance of the petitioner is that without addressing the objections raised by it, respondents 1 to 3 have been threatening to disconnect the power supply for non-payment of the revised bill amount.
Mr. O. Manohar Reddy, learned Standing Counsel appearing for the respondents, submitted that respondent No.2 will consider the objections raised by the petitioner against the revised bills and take a decision after giving the petitioner’s representative an opportunity of personal hearing.
In view of the submission of the learned Standing Counsel, this writ petition is disposed of with a direction to respondent No.2 to put the petitioner on notice, fix a date for enquiry and after hearing the representative of the petitioner, pass an order in writing and communicate the same to the petitioner. Till this process is completed, the respondents shall not disconnect the power supply to the petitioner for non-payment of the sum of Rs.43,63,940/- under revised bills for the months of February, 2013 to August, 2014.
As a sequel to the disposal of the writ petition, W.P.M.P.No.44837 of 2014 shall stand disposed of as infructuous.
