JUDGMENT / ORDER

It is noted that this matter had been adjourned on several occasions earlier due to the non-appearance of the appellant or her counsel. Though the learned counsel for the respondents seriously opposed the adjournment, the matter was posted to 06.10.2016, during the previous hearing. Since there was no representation, once again on 06.10.2016, the matter was adjourned at request of the appellant. Thereafter the matter was adjourned at the request of the appellant on five more occasions and finally it was adjourned to 10.01.2017. Since there was no representation for the appellant even on 10.01.2017, this Court directed the matter to be listed under the caption ?for dismissal? today.
2. Even today there is no representation for the appellant. The learned counsel for the respondents also submitted that the Appeal was dismissed for default in the year 2007 and the appellant has engaged different counsel at different stages for the purpose of protracting the proceedings. Having regard to the conduct of the appellant, this Court has no other option but to dismiss the Appeal for default. Hence, this Appeal Suit is dismissed for non-prosecution. No costs. Consequently, connected Miscellaneous petition is closed.
