JUDGMENT / ORDER

The Transfer Civil Miscellaneous Petition is filed by the petitioner-wife seeking transfer of HMOP.No.161/2012 pending on the file of the Subordinate Court at Kanchipuram to the Family Court at Thiruvallur.
2. It is stated that the wife is residing in Pattabiram along with her minor daughter, who is 5 years old and studying in Chennai and they are travelling from Thiruvallur to Kanchipuram to attend the court hearings which is more than 100 kms. away. Already, M.C.No.2/2015 filed by the petitioner-wife is pending before the learned Judicial Magistrate No.II, Tiruvallur for which the husband has to travel from Kancheepuram to Tiruvallur.
3. Despite service of notice and the name of the respondent printed in the cause list, the respondent has not chosen to appear either in person or through Counsel.
4. Considering the case of the petitioner, who has expressed her difficulty in travelling from Trivuallur to Kanchipuram to attend the court hearings along with her minor child, the H.M.O.P.No.161 of 2012 is transferred from the file of the Subordinate Judge, Kancheepuram, to the file of the Family Court, Tiruvallur. No costs. Consequently, connected Miscellaneous Petition is closed. 03.03.2017 Index:yes/no tsi To
