Present application has been filed for restoration of the main Appeal from Order on the ground that as now the office objections have been removed, appeal may be restored to file.
Learned counsel, Shri Pandya for the applicants submitted that the office objections could not be removed for the reasons stated and now as the same have been removed, appeal may be restored in the interest of justice. He has also stated that delay may also be condoned caused in filing present application.
Having heard learned counsel for the applicants and having considered the facts and circumstances, present application stands allowed in terms of Para Nos.7A & 7B. The order passed by this Court (Coram : M.D. Shah, J.) dated 23.08.2012, by which, main appeal was dismissed for non-prosecution, is hereby recalled. Appeal from Order No.330/2012 is restored to file. Rule is made absolute.
