Heard Sri Shashi Prakash Rai, learned counsel for the petitioner and Sri Ghanshyam Dwivedi, learned State counsel.
In this petition, petitioner has prayed for the following reliefs:
"(a) Issue a writ, order or direction in the nature of mandamus directing the Civil Judge (Senior Division) Azamgarh to decide the suit no. 524 of 2006, Anil Kumar vs. Regional Manager U.P.S.R.T.C. within stipulated period as specified by the Hon'ble Court.
(b) Issue a writ, order or direction in the nature of mandamus directing the Civil Judge (Senior Division), Azamgarh to fix a date for deciding the stay vacation application dated 19.05.2008 (Annexure No.7 to the writ petition)."
Considering the reliefs as prayed by the petitioner, we direct the concerned Civil Judge to decide the pending suit, if already not decided, expeditiously. If the petitioner wants any interim relief including that of vacating stay order, petitioner is at liberty to file appropriate application before the trial court.
It is made clear that this Court has not expressed any opinion on the merits of the case and the court below shall decide the suit strictly in accordance with law.
The writ petition is disposed of.
