Heard counsel for the petitioner.
The writ petition is being filed seeking following relief:
"issue, a writ, order or direction in the nature of mandamus directing the Respondent No. 2 (Sub Divisional Magistrate, Tehsil Tamkuhiraj, Kushi Nagar) to decide the Case No T2015 %2015054403166 (Amnager Vs. Radha Krishna and others), U/s 176 U.P.Z.A. & L.R. Act 1950 within stipulated period as directed by this Hon'ble Court"
Counsel for the petitioner after referring to the order sheet of the proceedings filed on record has submitted that although the written statement has been filed but issues have not been framed. It necessarily means that till date parties have not lead their evidence.
Under the circumstances the writ petition is disposed of directing the trial court to endeavour to decide the suit as expeditiously as possible preferably within a period of 18 months, from the date a certified copy of this order is filed before it.
