(K.S.JHAVERI, J.) ORDER IN CIVIL APPLICATION Rule returnable on 16.07.2012.
In the meantime, there shall be stay against the execution of the impugned judgment and award on condition that the applicant- appellant shall deposit the entire awarded amount together with proportionate costs and interest with the Tribunal on or before the returnable date. On the amount being deposited, the same shall be invested in the name of the Nazir of the Tribunal with a nationalized Bank by way of an FDR initially for a period of three years and on maturity shall be renewed by one year at a time without any further orders in this regard till the disposal of the appeal. The Fixed Deposit Receipt shall be retained with the Nazir of the Tribunal. The periodical interest that may be accrued on the said deposit shall be paid to the concerned respondents- original claimants by A/c payee cheque pending this appeal.
