This Civil Miscellaneous Appeal came before this Court on 28.02.2006, the learned counsel appearing for the appellant requested time and at his request the matter was adjourned. Again, this matter was listed before this Court on 11.11.2009, the learned counsel appearing for the appellant requested time and the matter was adjourned accordingly. Subsequently, the matter was listed on 26.11.2009, the learned counsel appearing for the appellant has not appeared and the matter has been adjourned.
2. Thereafter, the matter was listed today for admission. Even today, neither the appellant nor the counsel is not present and prosecute the matter. Therefore, this appeal is dismissed for non-prosecution. Consequently, connected miscellaneous petition is also closed. No costs.
