First Appeal No.1864 of 2012 In the facts of this appeal, learned counsel for the appellant relies on the legal position laid down by the Apex Court in paragraph 19 of the decision in the case of United India Insurance Co. Ltd vs. Laxmamma, reported in 2012 (4) SCALE 409 and submits that the Insurance Company is not liable to pay the amount of award impugned in this appeal.
