1.0 This Court on 13.02.2012 passed the following order:

"Mr.

Mazmudar, learned advocate for the appellant shall take action for unserved respondent no. 2 within a period of two weeks from today failing which appeal shall stand dismissed qua unserved respondent no. 2 for default. Matter to come up on 27.02.2012."

2.0 Inspite of the aforesaid order, learned advocate for the appellant has not taken any action. In that view of the matter, the application stands dismissed for default.

3.0. In view of dismissal of Civil Application, First Appeal also stands dismissed.
