The instant application is filed under section 5 of the Limitation Act seeking condonation of delay of 22 days caused in preferring the appeal.
2. Heard Ms. Pandya, Ld. Advocate for Ms. Bhaya, Ld. Advocate for the applicant and Mr. Thomas, Ld. Advocate for Mr. Nanavati, Ld. Advocate for the respondent no. 4. None appeared for the remaining respondents.
3. Having considered the submissions advanced, so also considering the grounds assigned for the delay, which are supported by the affidavit of the responsible officer of the Insurance Company, this Court is of the opinion that the delay has been sufficiently explained and deserves condonation.
4. For the foregoing reasons, the delay of 22 days caused in preferring the appeal is condoned. Rule is made absolute.
