Parikh, learned counsel for the applicant states that respondents nos. 1 and 2 are served and respondent no. 3 is not a necessary party.
Heard.
On the facts and circumstances of the case sufficient cause is shown to condone the delay. The delay is, therefore, condoned and the application is granted. Rule is made absolute with no order as to costs. First Appeal to be listed for admission on 30.01.2012.
