(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) 1.0 The appeal was not pressed with a view to availing alternative remedy of making an application for setting aside the impugned award, which was under challenge before learned Single Judge in the petition which is rejected by the impugned order.

2.0 Permission being granted. The appeal is disposed as withdrawn along with Civil Application without entering into any legal issues including the issue of maintainability of an application for setting aside an ex parte award at this stage.
