Heard the learned advocates for the parties.
On 23rd April 2012, this Court passed the following order:
" 1. Rule returnable on 18.06.2012.
2. In the meantime, ad-interim relief in terms of para 4 (A) on condition that the applicant shall deposit the entire amount awarded by the Tribunal along with interest and costs before the returnable date. On such amount being deposited, the same shall be invested by the Tribunal in the name of Registry of the Tribunal by way of a fixed deposit with a nationalised bank initially for a period of three years and on maturity shall be renewed by one year at a time without any further orders in this regard till the disposal of the appeal. The interest accruing on the said deposit shall be paid to the original claimants quarterly. The Fixed Deposit Receipt shall be retained by the Tribunal. "
Having heard the learned advocates for the parties, the ad-interim relief is confirmed. On depositing the awarded amount as directed by this Court by order dated 23.4.2012, the Tribunal is directed to invest 70% thereof in any Nationalized Bank in the name of the respondents-claimants initially for a period of three years with periodical renewal till the appeal is finally decided by this Court. Rest of the 30% of the amount is permitted to be withdrawn by the respondents-claimants by account payee cheque after proper verification subject to final result in the appeal. The FDR shall remain with the Nazir of the Court.
Rule is made absolute. This Civil Application stands disposed of.
