JUDGMENT / ORDER

Mr.Sanjay M. Amin, learned advocate for respondent Nos.1 and 2 states that the award under challenge in this appeal is passed under the provisions of Section-163(A) of the Motor Vehicles Act and that respondent Nos.1 and 2 have not preferred and do not intend to prefer any proceedings under Section 166 of the Motor Vehicles Act, in respect of the accident in question.
In view of the above statement made by the learned Advocate for respondents, Mr.Ajay Mehta, learned advocate for the appellant-Insurance Company states that he has no objection if the award impugned in this appeal is confirmed.
In view of the above, it is held that the award impugned in this appeal passed under Section 163-A of the Motor Vehicles Act will be treated as final award for all purposes, between the parties in respect of the accident in question. If, however, in future the respondents prefer any other claim application under the Motor Vehicles Act in respect of the same accident, the appellant shall be at liberty to file appropriate proceedings before this Court.
