The Secretary vs Dr.C.Vijayambika(In-Charge)

Madras High Court|19 January, 2017

JUDGMENT / ORDER

This Contempt Petition is filed complaining that the order passed in W.P(MD)No.2410 of 2015, dated 5.3.2015 has not been fully complied with.
2.The dispute between the parties pertains to the approval of 24 non- teaching staffs at the Petitioner-School.
3.It is contended by the Petitioner that though the respondents have approved fourteen non-teaching staffs, has however, not granted approval for the remaining 10 staff members in spite of the order passed by this Court.
4.On the other hand, it is seen that the order passed by this Court has not reached its finality, as the respondents have filed Writ Appeals in W.A(MD)Nos.461 and 462 of 2016 and those Writ Appeals are still pending. However, it is seen from the interim order passed by the Division Bench in those Writ Appeals, dated 22.4.2016 that the Joint Director of Collegiate Education was directed therein to grant approval for the remaining 10 staff members, pending dispose of those Writ Appeals.
5.When that being the factual position, I do not think that this Court can retain this Contempt on its file, as it is for the Petitioner to approach the Division Bench and file Contempt Petition, if the order passed by the Division Bench, dated 22.4.2016 is not complied with so far.
6.Therefore, this Contempt Petition is closed, by giving liberty to the Petitioner to file Contempt Petition before the Division Bench for re-dressal of his grievance, as stated supra.
