Petitioner seeks appointment of an arbitrator to resolve the disputes arising out of a tender agreement entered with the respondents; copy of which is produced at Annexure C.
In response to the notice issued, respondents have appeared through learned counsel, Ms. Maya Desai. It is not in dispute that there is arbitration clause in the agreement between the parties. In fact both sides jointly suggested that the dispute be referred to retired Judge of this Court namely Shri Akshay H. Mehta. Joint request is accepted. All disputes between the parties arising out of the tender agreement are referred for decision to the Hon'ble Judge. Petition is disposed of accordingly.
