JUDGMENT / ORDER

Leave to delete respondent No.3.
By way of the present petition, the petitioners have prayed for the following reliefs:
"A. xxx xxx xxx B. Your Lordship may be pleased to issue a writ in the nature of Mandamus or any other appropriate writ order or direction, directing to the District Collector, Rajkot i.e. respondent No.1 to pass necessary order/dispose the Land Appeal No.124/05-06 according to law within reasonable time preferably within a period of two month in the interest of justice.
C. During the admission, hearing and until final disposal of this petition Your Lordship may be pleased to direct the District Collector, Rajkot i.e. respondent No.1 to pass necessary order/dispose the Land Appeal No.124/05-06 according to law within reasonable time preferably within a period of two month in the interest of justice.
D. Your Lordship may be pleased to direct the respondent No.3 that they should maintain original status quo of the said disputed land which status of the disputed land was before handing over the possession by respondent No.3 to Vitcos City Bus Services for making private bus station on disputed land as on the date of filing of appeal before District Collector, Rajkot.

Considering the averments made in the petition, prayer at Paragraph No.13-D cannot be considered in view of the fact that the appeal is pending. However, prayer at Paragraph No.13-B deserves to be considered and District Collector, Rajkot be directed to decide the pending Land Appeal No.124/05-06 pending before him within stipulated time.
Heard Mr.Bukhari, learned advocate for the petitioners, and Ms.Asmita Patel, learned Assistant Government Pleader for respondent Nos.1 and
2. Considering the fact that the issue is pending since long and almost since seven years, the respondent-District Collector is directed to hear all the parties concerned and dispose of pending Land Appeal No.124/05-06 as expeditiously as possible, preferably latest by 31.12.2012.
With these observations, the petition is disposed of. There shall be no order as to costs.
