1.0 This Court on 19.12.2011 passed the following order:
"Mr.
Kinariwala, learned Advocate appearing for Mr. Bhargav Bhatt for the respondent No.1- original claimant states that the original claimant, viz., Kalabhai Kacharabhai Chaudhari has expired. With a view to enable Mr. Parikh, learned advocate appearing for the appellant to bring on record the legal heirs of the original claimant, matter is adjourned to 16.01.2012."
2.0 Inspite of the aforesaid order, learned advocate for the appellant has not preferred the application for bringing legal heirs of the original claimant on record. In that view of the matter, the appeal stands dismissed for default.
