The finding of facts recorded by the learned Tribunal in para 19 of the impugned award are pertaining to pre-existence of insurance policy since the cover note for the period from 20.03.1987 to 27.03.1988 was produced at Exh.151, however, the accident had taken place on 23.10.1986. The above findings are based on appreciation of record produced before the Tribunal and deposition of the officer of the Insurance Company about remark on the cover note about code of the insurance policy along with Branch and Agent number, and therefore, prima facie the findings of the Tribunal on the above aspect cannot be said to be in any manner contrary to the documentary evidence on record.
However, learned advocate the insurance company seeks time.
