ORDER IN FIRST APPEAL Having considered the submissions advanced by Mr. Mazmudar, learned advocate for the appellant, so also considering the impugned order passed by the Tribunal u/s.140 of the MV Act, the appeal is admitted.
ORDER IN CIVIL APPLICATION I have taken into consideration the submissions advanced by Mr. Mazmudar, learned advocate for the applicant - appellant, so also considering the impugned order passed by the Tribunal u/s.140 of the MV Act, Rule returnable on 1.10.2012. In the meanwhile, there shall be ad-interim stay in terms of paragraph 8(A) on the condition that on or before the returnable date, the applicant - appellant shall deposit with the concerned Tribunal the awarded amount together with proportionate interest and cost.
