JUDGMENT / ORDER

The petitioners, husband and wife, had deposited an amount of `2,50,000/- with the 1st respondent Society on 11.10.2013 for a period of 91 days. The interest offered was 9.25% per annum. The maturity date of the deposit was 10.01.2014. When the petitioners approached the 1st respondent for return of the amount of fixed deposit, they were informed that sufficient funds were not available. The petitioners thereupon caused the issue of a notice through their lawyer demanding payment of the amount. To the said notice, Ext.P3 reply has been issued. In Ext.P3 reply what is alleged is that, the 2nd petitioner who had retired from the service of the Society as its Secretary had received Gratuity in excess of what was actually due to her. It is also alleged that, an amount of `30,950/- is due from her for the loss caused to the Society while she was an employee. The petitioners have thereupon submitted Ext.P4 complaint to the 2nd respondent seeking his intervention in the matter.

According to Adv.Sri.V.G.Arun who appears for the petitioners, no disciplinary proceedings have been initiated against the 2nd petitioner at any time during her tenure as an employee of the 1st respondent. No disciplinary proceedings are pending against W.P.(C) No.9270 of 2014 2 her. No quantification of any liability as alleged in Ext.P3 has been made with notice to the 2nd petitioner. It is alleged that, the present allegations are made without any basis for the only purpose of retaining the petitioners' money. I have heard the learned Government Pleader also.
3. Since Ext.P4 complaint is pending before the 2nd respondent, it is only appropriate that the said authority considers the same and works out a solution to the issue. A solution without further delay is necessary to be worked out for the reason that, the petitioners are stated to be in urgent need of money.
This writ petition is therefore disposed of directing the 2nd respondent to consider Ext.P4 complaint of the petitioners in accordance with law, as expeditiously as possible and at any rate within a period of three weeks of the date of receipt of a copy of this judgment.
