This writ petition is filed challenging Ext.P4 order by which the approval of the appointment of the petitioner as Headmistress in A.M. U.P. School, Pazhur was declined by the fourth respondent. The reason stated in Ext.P4 order for declining approval of the appointment of the petitioner is that she does not possess the qualification prescribed under the Right of Children to Free and Compulsory Education Act, 2009 and the rules made thereunder. 2. Ext.P7 order produced by the petitioner along with I.A. No.7812 of 2014 indicates that the Government has exempted the teachers who have completed the age of 50 years from acquiring the qualification prescribed under the Right of Children to Free and Compulsory Education Act, 2009 and the rules made thereunder.
3. The learned Government Pleader has pointed out that W.P.(C).No.2615 of 2014 2 Ext.P7 order of exemption was under challenge before this Court in W.P.(C) No.14971 of 2014 and the challenge was repelled by this Court, as per the judgment rendered in the said case on 24.06.2014.
4. In the light of Ext.P7 order of the Government, Ext.P4 order is liable to be quashed. Accordingly, Ext.P4 order is quashed and the fourth respondent is directed to approve the appointment of the petitioner as Headmistress of the school referred to above w.e.f. 12.06.2013.
The writ petition is allowed as above.
