JUDGMENT / ORDER

1. Petitioner is aggrieved with the sale proceedings initiated by the respondent society, for satisfaction of a loan. Default is admitted and sale proceedings had culminated in the respondent society purchasing the land. However, the learned counsel for the society, on behalf of the society, submits that, if the entire amounts due as on today along with expenditure incurred by the respondent society are paid to the respondent society, the respondent society is willing to resume the property to the petitioner.
2. In such circumstances, if the petitioner approaches the respondent society within a period of two weeks from today, the respondent society shall give the petitioner a statement of accounts due under the loan account along with expenditure incurred in effecting sale and conveyance, taken in the name of the society, as also any other W.P.(C)No.8191 of 2010 -:2:-
incidental expenses. The statement of accounts shall show the interest due as on 31.12.2014. The respondent society shall grant the petitioner three months' time from 31.12.2014 to settle the entire dues. When the entire amounts are settled, the respondent society shall raise any further demand for future interest from 31.12.2014. On the said demands being satisfied, subject to the condition that the petitioner shall bear the expenses for re-conveyance; the respondent society shall re-convey the property to the petitioner.
Writ petition is disposed off.
