P.B.Suresh Kumar, J. The decree and judgment in O.S. No.51 of 2007 on the file of the Court of the Subordinate Judge, Thiruvalla is under challenge in this appeal. The plaintiff in the suit is the appellant.
2. In this appeal, as per order dated 22.7.2014, the parties were referred for mediation to the Ernakulam Mediation Centre and the matter has been settled between the parties at the mediation. The mediation settlement signed by the parties is part of the records. As per the terms of settlement, the appellant has agreed to withdraw the appeal. In the light of the mediation settlement, the appeal is dismissed as withdrawn.
Since this matter is settled at the mediation, in view of Section 69A of the Kerala Court Fees and Suit Valuation Act, the court fee paid on this appeal shall be refunded to the R.F.A. No.69 of 2010 2 appellant. A copy of the mediation settlement shall be appended to this judgment and the original shall be preserved.
