JUDGMENT / ORDER

The petitioner is a resident falling within the territorial limits of Moonakkal Palli Wakf. Petitioner submits that the large revenue received by the Wakf is remain unaccounted obviously to circumvent contribution to be paid to the Wakf Board. It is also submitted that the committee failed to keep proper accounts in respect of revenues and expenditure. The petitioner raised a complaint. It seems an enquiry has been ordered under Section 33 of the Wakf Act. The grievance of the petitioner is that no action has been taken to finalise the proceedings initiated under Section 33 of the Wakf Act. 2. Learned Standing Counsel submits that enquiry is going on and it will be concluded after obtaining necessary materials and other evidence. This Court, as per interim order dated 26.3.2014, directed the Chief Executive Officer to permit the petitioner to take part in the proceedings initiated under Section 33 of the Wakf Act.

Considering the facts and circumstances, there shall be a direction to the Chief Executive Officer to conclude the enquiry under Section 33 of the Wakf Act within a period of three months from the date of receipt of a copy of this judgment. Needless to say, an opportunity of hearing shall be given to the petitioner as well as the office bearers of the registered Wakf including party respondents 2 to 5.
4. The petitioner submits that in spite of Ext.P25 notice, addressee of that notice had not appeared before the Chief Executive Officer. If proceedings have been initiated pursuant to Ext.P25 notice, there shall also be a direction to the Chief Executive Officer to pass appropriate orders on Ext.P25 and do the needful within a period of two months from the date of receipt of a copy of this judgment. Petitioner and other affected parties are also to be heard before finalising the proceedings based on Ext.P25.
This Writ Petition is disposed of as above.
