JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) Argument in this matter is going on since long. Today, learned Assistant Solicitor General, Mr. Champaneri states that there is no formal notice issued to the Union of India through Regional Director, Ministry of Corporate Affairs, Western Region, Ahmedabad in connection with this appeal.
Issue Notice to the the Union of India through Regional Director, Ministry of Corporate Affairs, Western Region, Ahmedabad.
Mr.Champaneri, waives service of notice and states that before the learned Single Judge an affidavit is already filed on behalf of Regional Director and he shall take appropriate instructions as to whether he would like to argue any additional point or would adopt the arguments of Income-Tax Department and reiterate the affidavit filed before the learned Single Judge.
The appeal memo and other documents may be supplied by the appellant to the other side.
In the meanwhile, the matter may proceed and learned Senior Counsel, Mr.Mihir Joshi, for the appellant may submit his rejoinder to the arguments advanced by the learned Senior Counsel, Mr. Mihir Thakore.
In short, it will not be necessary for the said authority to file further affidavit in these proceedings, as affidavit is already filed before the learned Single Judge, on which he can rely.

B. MAJMUDAR, J.) (MOHINDER PAL, J.) FURTHER ORDER After the aforesaid order is passed, both the learned counsel have concluded their arguments. For hearing Mr.Champaneri, learned Assistant Solicitor General appearing on behalf of Regional Director, the matter is adjourned to 4.7.2012.
