This petition seeks appointment of a Sole Arbitrator to resolve disputes between the petitioner and respondent invoking the clause for dispute resolution in Contract No.TBM/SG/CN/337/1/73/3/KGZ- MTL/E1/Cont dated 08.10.2012 between the parties.
2. When the matter is called for hearing today, both learned counsel appearing for the petitioner as well as respondent agree that a retired District Judge be appointed as Sole Arbitrator.
3. I, thus, appoint Ms. M. Rajalakshmi, District Judge and Additional Judge, (Retd), No.28/49, II Floor, M.G.R. Street, Besant Nagar, Chennai - 90 Mobile No.8754920985, as the Sole Arbitrator to enter upon reference and adjudicate the disputes inter se the parties and after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible, preferably within a period of six months from the date of receipt of the order. The learned Arbitrator is at liberty to fix her remuneration and other incidental expenses, which shall be borne by both the parties equally. The proceedings may be conducted under the aegis of the Madras High Court Arbitration Centre in accordance with the Madras High Court Arbitration Rules.
4. The Original Petition is, accordingly, allowed, leaving the parties to bear their own costs.
