JUDGMENT / ORDER

The dispute in the present case concerns the grant of licence to a quarry conducted by the petitioner. The quarry is being conducted in the property of the Government having an extent of 90 cents in survey No:332/1 of Enanalloor Village in Muvattupuzha Taluk. According to Adv.Peeyus A. Kottam who appears for the first respondent Panchayat, the term of licence of the petitioner has already expired. The petitioner has not submitted an application for licence in respect of the current year 2014-2015. If a proper application is submitted the counsel assures that the same would be considered. The learned Senior Counsel Shri.Jaju Babu submits that the petitioner would submit a fresh application for renewal of the licence issued under Section 232 of the WPC 13539/2013 2 Kerala Panchayat Raj Act, 1994 (the 'Act' for short). According to the counsel, the petitioner has been issued with all other licences necessary for the conduct of the quarry. In view of the above this writ petition is disposed of granting liberty to the petitioner to submit a fresh application for renewal of the licence under Section 232 of the Act within a period of one week of the date of receipt of a copy of the judgment. The second respondent is directed to consider the said application in accordance with law and untrammelled by any of the observations made in the previous proceedings between the parties and to pass appropriate orders thereon, in accordance with law, as expeditiously as possible and at any rate within a period of one month of the date of submission of the application.
