JUDGMENT / ORDER

The petitioner, who is the wife, seeks transfer of H.M.O.P.No.77 of 2017 filed by the respondent/husband before the Family Court, Tiruchirappalli, seeking divorce on the ground of cruelty. The transfer is sought for mainly on the ground of convenience of the petitioner/wife.
2. The petitioner/wife claims to be a resident of Vedaranyam in Nagapattinam District. Even in the Original Petition in H.M.O.P.No.77 of 2017 filed before the Family Court, Tiruchirappalli, the petitioner/wife is shown to be a resident of Vedaranyam in Nagapattinam District.
3. It is also seen that the daughter born out of the said marriage is living with the petitioner/wife. She has sought for transfer of the proceedings to the Sub Court, Vedaranyam. Since there is no Sub Court at Vedaranyam, the proceedings should be transferred to any other Sub Court near Vedaranyam.
4. Considering the convenience of the petitioner/wife, the proceedings in H.M.O.P.No.77 of 2017 are withdrawn from the file of the Family Court, Tiruchirappalli and transferred to the file of the Sub Court, Nagappattinam. The Family Court, Tiruchirappalli, is directed to despatch the papers in H.M.O.P.No.77 of 2017 to the file of the Sub Court, Nagapattinam, within a period of two weeks from the date of receipt of a copy of this order.
5. In the result, this Transfer Civil Miscellaneous Petition is ordered as above. No costs. Consequently, the connected civil miscellaneous petition is closed.
