JUDGMENT / ORDER

Heard learned counsel for the petitioner, learned State Attorney as well as learned counsel appearing for 6th respondent.
2. According to petitioner, he has licensed toddy shops as TS Nos.18 to 24 in Group No.IV of Kuttampuzha Excise Range in Ernakulam District. So far as TS Nos.22 and 24 of Kuttampuzha Excise Range, 6th respondent and his followers are not permitting the petitioner to run the toddy shops smoothly by causing obstruction at the time of unloading the goods. A complaint is lodged against 6th respondent and others as well.
3. According to 6th respondent, shop No.24 is situated in between two tribal settlements and the female members of the settlements are objecting and even a writ petition is filed seeking shifting of the said toddy shop. He further submits, he has never caused any trouble and he has no such intention. Surprisingly, in WP(C) No. 11949 of 2014 -:2:-
the criminal case registered, first accused is the 6th respondent. The fact remains, there is valid licence for the petitioner to run these two shops in the said area. Till the competent authority takes a decision to shift these shops, none of the public could raise any grievance about it. According to petitioner, subsequent to interim order, there is no law and order situation at the spot.
4. Having regard to the above submission we make the interim order dated 09.05.2014 absolute and direct the respondent Police to take action whenever there is law and order problem created at the hands of 6th respondent or his followers.
The Writ Petition is disposed of as above.
