JUDGMENT / ORDER

The petitioner is aggrieved with the non consideration of the application for renewal of regular permit filed as per Ext.P1 and the application for temporary permit, Ext.P2, pending such consideration. 2. The petitioner admittedly, was operating a Super Fast Service which, at this point, is not permissible to be renewed in the name of the private service operators, since as per a Scheme brought out in Notification No.10689/B1/2014/Tran. Dated 17.07.2014 the Government restricted the Fast Passenger Services to the KSRTC. However, the said notification itself prescribes that the existing permits shall be revoked on the basis of “first expiring-first revoked” when KSRTC commences WP(C).34241/14 2 service in the route. The Government however, having considered the issue and got the opinion of the KSRTC, was convinced that the KSRTC could not displace all the regular permit operators and private services thereon. In such circumstances, it was decided that the temporary permit applications will be considered as stop- gap arrangement. In that context, the application for temporary permit, Ext.P2, would be considered within a period of two weeks from today and the same granted after hearing the KSRTC, if there is no legal impediment. There can be no directions issued at this point for consideration of the renewal of the regular permit application.
With the above observation, the writ petition is disposed of.
