When the matter came up for hearing on 13.02.2017, there was no representation on behalf the appellant and hence, it was posted today under the caption ?For dismissal?. Today, at about 01.05 p.m., when the matter was taken up for hearing, there was no representation for the appellant. However, it was passed over and at about 03.05 p.m., when the matter was taken up for hearing, again there was no representation for the appellant. In such circumstances, this Court has no other option except to dismiss the second appeal for non-prosecution.
2. Accordingly, the second appeal is dismissed for non-prosecution. No costs. Consequently, connected civil miscellaneous petition is closed.
