The present Criminal Original Petition has been filed to modify the order dated 27.01.2017 passed by the learned Judicial Magistrate, Tambaram, Kancheepuram District in Crl.MP No.709 of 2017.
2. It is the case of the petitioners that they were arrested and remanded to judicial custody on 30.09.2016. While so, they filed a petition in CMP.No.709 of 2017 before the learned Judicial Magistrate, Tambaram, seeking statutory bail. By order dated 27.01.2017, the said petition was ordered, by granting bail to the petitioners, subject to certain conditions, one of which is that the petitioners shall execute their own bond for a sum of Rs.10,000/- along with two sureties, one should be a Government surety and another one should be blood relation. Since the petitioners are unable to furnish a Government surety, they filed the present petition seeking modification of the said condition.
3. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the respondent.
4. Considering the facts and circumstances of the case and also taking note of the inability of the petitioner to furnish a Government surety, this Court is inclined to modify the said condition. Accordingly, each of the petitioners shall execute a bond for a sum of Rs.10,000/- with two blood relation sureties for a like sum to the satisfaction of the court concerned. Except the same, the other condition remains unaltered.
5. With the above modification, this Criminal Original Petition is disposed of.
