Heard Sri Pankaj Kumar Shukla, learned counsel for the petitioner, Sri Q.H. Rizvi, learned Standing Counsel for the respondent nos. 1 to 3 and 5 and Sri Dhirendra Singh, learned counsel for the respondent no. 4.
By this public interest litigation the petitioner is praying for issuance of writ of mandamus directing the respondents to initiate the enquiry of irregularities committed by the agency in question in purchasing of paddy crops from Veerprabhu Gurukripa center in the year 2016-17.
On the matter being taken up today, Shri Rizvi, learned Standing Counsel has raised a preliminary objection that regarding the bonafide and credentials of petitioner, there is no averment in the present Public Interest Litigation and in view of the provisions contained under Chapter XXII Rule1 Sub-Rule 3(A) of Allahabad High Court Rules, 1952 nor there is any material regarding violation of any rule in purchasing the paddy crops, therefore, the present Public Interest Litigation is not at all maintainable.
We have proceeded to consider the declaration so averred in the writ petition and what we find that the said disclosure is not in consonance with the sub-rule (3A) of Rule 1 of Chapter XXII of the Allahabad High Court Rules, 1952, therefore, we are not inclined to pass any order in the writ petition which has been filed in the shape of public interest litigation.
Present public interest litigation is, accordingly, dismissed.
