Heard Sri Kailash Nath, learned counsel for the applicant, Sri Anil Pratap Singh, learned counsel for Opposite Party No. 2, and Sri G.P. Singh, learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been filed with a prayer to direct the Sessions Judge, Varanasi to decide the Bail Application No. 2687 of 2019 in Case Crime No. 0725/2019 under Sections 376-D, 342, 323, 506 I.P.C., P.S.
Cant, District Varanasi within a short stipulated period.
It is argued by the learned counsel for the applicant that the accused applicant has been lying in jail since 24.06.2019 and despite the bail application having been moved before the learned Sessions Judge, the same has been kept pending and has not been decided till date.
Learned counsel for the O.P. No.2 apprised this Court that in this case 1.08.2019 has been fixed by the trial court for hearing.
Learned A.G.A. has no objection if the direction is issued to the learned trial court for expeditious disposal of the bail application.
In view of the above, this Court directs the trial court to make all possible efforts to decide bail application of the accused on the next date fixed i.e. on 1.08.2019 unless there is no legal impediments.
With this direction, this Application under Section 482 Cr.P.C. is disposed of.
