Heard counsel for the petitioner and Standing Counsel for State of UP.
The present writ petition has been filed for mandamus directing the respondents no. 2/ District Magistrate, Banda to decide the representation dated 26.07.2019 of the petitioner regarding grant of arm licence within specific period as fixed by this Hon'ble Court.
The counsel for the petitioner submits that after death of father of the petitioner, the petitioner applied for arm licence on 27.11.2018 under Rule 11 of Arms Rules, which is still pending. Feeling aggrieved by the respondents' action in not deciding the application of the petitioner regarding issuance of arm licence, the petitioner preferred a representation before respondent no. 2 on 26.7.2019, which is still pending and same may be decided by respondent authority within stipulated time as fixed by this Hon'ble Court.
The learned Standing Counsel has no objection to aforesaid submission.
Without entering into the controversy involved in the writ petition, the writ petition is disposed of with direction to respondent no. 2 to decide the representation of the petitioner dated 26.07.2019, expeditiously, preferably within a period of two months from the date of producing a certified copy of this order before the concerned authority, in accordance with law, provided there is no other legal impediment.
It is made clear that this Court has not adjudicated the claim of the petitioner on merit.
