Heard learned counsel for the petitioner and learned AGA for the State.
The limited relief pressed for by means of this petition is for appropriate direction to the respondent no.1 Secretary, Department of Home, Government of U.P. to take an appropriate decision on the pending application of the petitioner dated 21.07.2016 (annexure-5 to the writ petition), whereby the petitioner has prayed for transfer of the investigation to the superior agency namely C.B.I. so that fair and partial investigation is made to the case crime mentioned in the said representation.
Learned counsel for the petitioner submits that despite the fact that the application is pending for more than one and half year and till date no decision has been taken by the State.
Considering the facts and circumstances of the case, we dispose of the writ petition with direction to the respondent no.1 Secretary, Department of Home, Government of U.P. to pass appropriate order on the pending application of the petitioner referred above strictly in accordance with law within a period of six weeks from the date of production of a certified copy of this order. It would be open to the petitioner to submit a representation along with a certified copy of this order.
