High Court Of Judicature at Allahabad|31 October, 2018
|

JUDGMENT / ORDER

Court No. - 6
Case :- WRIT - A No. - 17908 of 2018 Petitioner :- Vivek Kumar Tiwari Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Yogesh Agarwal,Monisha Dev Kumar Counsel for Respondent :- C.S.C.
Hon'ble Yashwant Varma,J.
Heard learned counsel for the petitioner and the learned Standing Counsel.
The only ground of challenge with respect to the impugned order is that the petitioner has been frequently transferred. The additional submission is that the transfer fell foul of the guidelines framed by the State Government.
This Court finds itself unable to evaluate or to accept either of the contentions raised, since the order of transfer has been made on the ground of administrative exigency and is not shown to fall foul of any statutory rules governing the terms and conditions of services of the petitioner.
The additional argument of the transfer being in violation of guidelines would also not warrant invocation of the jurisdiction under Article 226 of the Constitution.
Accordingly, the petition fails and is dismissed.
