JUDGMENT / ORDER

Hon'ble Saurabh Lavania,J.
Heard.
In this writ petition the petitioner who was a candidate in elections to the Gram Panchayat has filed this writ petition for issuance of a writ in the nature of Mandamus to recount the votes. He says that he had filed objections, but they were not considered.
It is an admitted factual position that the elections are over and the results have been declared. Once it is so, then the remedy for the petitioner is to file an election petition under section 12-C of the U.P. Panchayat Raj Act 1946. A writ petition under Article 226 of the Constitution of India is not maintainable at this stage. The writ petition is dismissed only for this reason. As regards contention of learned counsel for the petitioner that his objections were not considered, this plea can also be raised in the election petition.
