The prayer made in the instant petition is for issuing direction to the trial court to decide Original Suit No.242 of 2017 within a stipulated period.
Counsel for the plaintiff-petitioners points out that the suit is fixed for recording of exparte evidence. A perusal of the order sheet reveals that the order of temporary injunction passed in favour of the petitioners is being extended from time to time.
Since the court below is already fixing date for recording of exparte evidence, it is always open to the petitioners to avail the said opportunity but at this stage, no case is made out for issuing any direction.
The petition stands disposed of accordingly.
