Heard learned counsel for the petitioner, learned Standing Counsel for the State and Shri Rohit Pandey, learned counsel for the respondent No.2, Chhatrapati Shahuji Maharaj University, Kanpur through its Registrar.
Present Writ Petition under Article 226 of the Constitution of India has been filed for issuance of a writ of mandamus commanding the respondents to permit the petitioner to appear in the L.L.B. IIIrd Year Vth Semester Examination 2019- 2020.
The contention of learned counsel for the petitioner is that the petitioner was admitted for pursuing the law course for the Academic Session 2012-2013 and he appeared in the L.L.B. IIIrd Year examination for the Academic Session 2016-2017, but he has not passed fourth and fifth paper due to illness and remained absent and now, he wants to appear in the L.L.B. IIIrd Year Vth Semester Examination 2019-2020.
Learned counsel for the Chhatrapati Shahuji Maharaj University, Kanpur through its Registrar, respondent No.2 submits that the representation in this regard had already been filed by the petitioner to the Registrar of the Chhatrapati Shahuji Maharaj University, Kanpur on 10.7.2019, copy of the same has already been appended as Annexure No.5 to the Writ Petition and he has no objection in case Examination Controller of the Chhatrapati Shahuji Maharaj University, Kanpur is directed to decide the same.
Under these circumstances, direction is issued to the Examination Controller, Chhatrapati Shahuji Maharaj University, Kanpur to take decision on the representation of the petitioner dated 10.7.2019, appended as Annexure No.5 to the Writ Petition, as expeditiously as possible, preferably within a period of three weeks from the date of production of a certified copy of this order before him.
