Heard learned counsel for the petitioners.
Learned counsel for the petitioner has invited this Court s attention to page-22 - final notice dated 19.05.2012, wherein, the insistence was made for obtaining 2 acres of land for construction constructing building. The information received under RTI Act reproduced at page 43 and 44 also indicate that the insistence of 5 acres of land is in respect of new affiliation for the Academic Year 2012-2013. In light thereof, the impugned notice dated 20.02.2013 is uncalled for, as the said notice indicate insistence of 5 acres of land, which is not requirement of law so far present petitioner is concerned.
In light thereof, the Court is inclined to issue notice returnable on 18.03.2013. In the meantime and till the returnable date, the notice at page-17 is stayed with a specific observation that the affiliation may not be discontinued only on account of insistence of 5 acres of land, but it will be open for the University to take action for snapping the affiliation, if otherwise it is permissible, as the petition is filed only qua 5 acres of land for putting up building. Direct service permitted today.
