JUDGMENT / ORDER

The prayer for impleadment put in by the petitioner in the suit is not being opposed by the respondents. The extent of the right claimed by the petitioner in the property can only be deciphered at the time of trial of the suit. The petitioner is therefore impleaded in the suit as a proper party even if not a necessary party.
2. The impugned order is set aside and I.A. No.
2298/2013 in O.S. No. 256/2006 on the file of the court of the Additional Munsiff of Alappuzha is allowed. The court below is directed to dispose of the suit in O.S. No. 256/2006 within a period of four months from the date of production of a copy of this judgment.
The Original Petition is disposed of.
