Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Vismillah who is involved in Case Crime No. 270 of 2016, under Sections 3/5/8 Cow Slaughter Act and Section 11 Animal Cruelty Act, Police Station-Dumariyaganj, District-Siddharth Nagar.
As per prosecution version, on 7.4.2016 at about 3:00 AM applicant and other co-accused were slaughtering cow. Police reached on the spot but applicant and other co-accused fled away from the spot have been identified by the police.
Learned counsel for the applicant contended that there is criminal history of two cases against the applicant and in both cases, applicant is on bail and the applicant was not arrested from the spot. He further contended that co-accused Zahoor Ullah, Dost Mohammad @ Dasai, Ramish, Hakim and Bechan have already been enlarged on bail vide order dated 28.7.2016 passed by this Court in criminal misc. bail application No. 25351 of 2016.
Learned A.G.A., has opposed the prayer for bail.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Vismillah, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
