Heard learned counsel for the petitioner, learned State Counsel and Shri Shikhar Anand, learned counsel appearing for U.P. Public Service Tribunal.
The petitioner appears to be a class IV employee in an Intermediate Recognized Institution. Challenging his suspension order, he has filed a claim petition before the State Public Service Tribunal which has been dismissed vide order dated 29.01.2021. However, while dismissing the claim petition the learned Tribunal has expressed its expectation that the Principal of the Institution concerned shall consider and decide the representation which is said to have been made by the petitioner seeking revocation of his suspension. The said expectation appears to have been expressed by the Tribunal as the petitioner had restricted his prayer before the Tribunal for issuing such a direction.
In the aforesaid view of the matter, we are not inclined to interfere in this writ petition which is finally disposed of with the direction to the Principal of the Institution concerned to consider and decide the representation said to have been preferred by the petitioner seeking revocation of his suspension. The appropriate orders shall be passed by the Principal concerned within a period of four weeks from the date of production of certified copy of this order.
