Vishwanath vs Paschim

High Court Of Gujarat|18 June, 2012

JUDGMENT / ORDER

Present petitioner had earlier preferred a writ petition being Special Civil Application No.563 of 2012. In the said writ petition, the petitioner prayed for below mentioned relief:-
"(25) (a) Issue a Writ of Prohibition in favour of the Petitioners and against the Respondents restraining the Respondents from blacklisting the Petitioners by declaring the Respondents' impugned show cause notices dated 16.11.2011, 30.11.2011 and 20.12.2011 at Annexure - 'O/1', 'O/3' and 'O/5' to be arbitrary, illegal, unilateral, unjust and unconstitutional by an appropriate writ.
(b) Restrain the Respondents from proceeding and deciding the said three show cause notices dated 16.11.2011, 30.11.2011 and 20.12.2011 at Annexure
- 'O/1', 'O/3' and 'O/5' till the decision of this Petition by an appropriate writ."
1.1 Now, the petitioner has taken out present petition seeking below mentioned relief:-
"26 a) This Hon'ble Court be pleased to issue a writ of mandamus and/or any other appropriate writ, order or direction in the nature of mandamus holding and declaring that order/circular dated 11.05.2012 (Annexure-Q) is erroneous, illegal and contrary to facts and law and therefore, same be quashed and set-aside and the respondents herein be directed to withdraw the said blacklisting letter and to inform all the 51 addressees who are informed that the letter of blacklisting circular is withdrawn."
2. It is noticed that in earlier matter, grievance was with respect to blacklisting the petitioner and against the show cause notices which were issued for the said purpose whereas, in present petition, it appears that the petitioner has made reference of order/circular dated 11.5.2012 which also pertains to blacklisting the petitioner.
3. Under the circumstances, office is directed to examine the matters. It seems that the matter ought to be placed before the Division Bench. Therefore, after examining the earlier petition and present petition, office to take necessary action and place the matter before appropriate Bench, in accordance with present roster.
