Nobody appears in support of delay condonation application for condoning the delay in filing the appeal.
It stands rejected for want of non prosecution.
Writ petitioner - appellant, served with the notice dated 30th of September, 2005, whereby he was informed that he will retire on the said date on attaining the age of superannuation.
Three years thereafter, writ petitioner - appellant challenged the aforesaid order on the ground that his date of birth ought to have been recorded taking into account the entry made in the High School Certificate.
The learned Single Judge declined to interfere in the matter on the ground that the writ petitioner - appellant has approached the Court after three years of the date of retirement.
Mr. K.K. Rajbhar, learned counsel appears on behalf of respondent Nos. 2, 3 and 4. Standing Counsel appears for the State - respondent no.1.
Consequently, appeal being barred by limitation also stands dismissed.
