ORDER Learned counsel for the petitioner files a memo dated 04-11-2019 to withdraw the petition with a prayer to direct the court below to dispose off the suit expeditiously.
2. The petitioner’s suit is for recovery of money.
Initially, application was filed under Order 37 Rule 3 read with Section 151 of CPC. On appearance, the defendants filed written statement, which was taken on record and application filed by the petitioner-plaintiff under Order 37 Rule 3 read with Section 151 of CPC was rejected and the suit was treated as regular suit and was posted for framing issues.
3. The memo is placed on record. The Civil Revision Petition is dismissed as withdrawn.
4. Taking note of the nature of suit, the trial Court is directed to dispose off the suit expeditiously with the cooperation of the parties.
