Heard Sri R.P. Yadav, learned counsel for the petitioner and learned Standing Counsel for the State.
Petitioner has filed this petition seeking a direction to respondent no.3 i.e. Tehsildar, Tehsil Derapur, District-Kanpur Dehat to mutate the name of the petitioner in revenue record over the land being old Gata No.1733/3 measuring area 0.12-00 and Gata No.1733/4 measuring area 0.6-0 (now new Gata No.983B) total measuring area 0.1020 Hectare situated in village Ban, Tehsil Derapur, District-Kanpur Dehat, in compliance of the order dated 07.07.1978 of the respondent No.4. in this regard again petitioner filed representation dated 02.09.2020 before respondent No.3, which is still pending.
It is submitted that respondent no.3 i.e. Tehsildar, Tehsil Derapur, District-Kanpur Dehat be directed to decide this pending representation in compliance of the order dated 07.07.1978.
This prayer is not opposed by learned Standing Counsel for the State.
In view of such facts, this writ petition can be disposed of with a direction to respondent no.3 i.e. Tehsildar, Tehsil Derapur, District-Kanpur Dehat to decide the pending representation of the petitioner on its own merits, referred to above, if possible, within a period of 90 days from the date of receipt of computer downloaded copy in PDF form of this order strictly in accordance with law.
In above terms, the writ petition is disposed off.
It is made clear that this Court has not expressed any opinion on the merits of the case.
